FanCake – Terms of Service

Welcome to FanCake, operated by Roberto Calvo Productions LTD, a company registered in the United Kingdom, with its registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (“RCP,” “we,” “our,” or “us”).

By accessing or using FanCake (the “Platform”), you agree to these Terms of Service (“Terms”). Please read them carefully before using the Platform.

 

 

 

 

1. Eligibility

 

 

You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to use FanCake. By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement.

 

 

 

 

2. Account Registration

 

 

To access certain features, you must create an account. You agree to:

 

  • Provide accurate and up-to-date information;

  • Keep your credentials secure and confidential;

  • Accept full responsibility for all activity under your account.

 

 

FanCake reserves the right to suspend or terminate any account that violates these Terms or applicable laws.

 

 

 

 

3. Platform Usage

 

 

Users agree not to use FanCake to:

 

  • Post, upload, or distribute illegal, abusive, defamatory, or fraudulent content;

  • Harass, intimidate, or exploit others;

  • Promote hate, violence, or discrimination;

  • Upload sexually explicit material, unless explicitly allowed and compliant with applicable law;

  • Infringe on third-party copyrights, trademarks, or intellectual property rights;

  • Engage in spam, bots, or fraudulent transactions.

 

 

FanCake may remove any content or suspend accounts that violate these guidelines.

 

 

 

 

4. Payments and Fees

 

 

All payments on FanCake are processed through Stripe or PayPal.

When a fan supports a creator:

 

  • FanCake automatically retains a platform fee at the moment of the transaction;

  • The remaining funds are sent directly to the creator’s Stripe or PayPal account;

  • FanCake does not hold or manage funds on behalf of users.

 

 

Creators are solely responsible for reporting and paying any taxes applicable to their income and for complying with local financial and tax regulations.

 

 

 

 

5. Refund Policy

 

 

All payments are considered final and non-refundable.

Any dispute or refund request must be handled directly between the fan and the creator, in accordance with the respective Stripe or PayPal policies. FanCake does not issue or manage refunds.

 

 

 

 

6. Intellectual Property

 

 

Creators retain ownership of all content they upload to FanCake.

By uploading content, you grant FanCake a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content solely for the purpose of operating and promoting the Platform.

 

Users may not copy, reproduce, or distribute content from FanCake without the prior written permission of the rights holder.

 

 

 

 

7. Termination and Suspension

 

 

FanCake may suspend or terminate your account at any time, with or without notice, if you:

 

  • Breach these Terms;

  • Engage in illegal or fraudulent activity;

  • Cause harm to other users or to the Platform;

  • Violate payment or content policies.

 

 

You may close your account at any time through your profile settings.

Outstanding fees and obligations remain valid even after account closure.

 

 

 

 

8. Disclaimers

 

 

FanCake is provided “as is” and “as available.”

We make no warranties regarding availability, performance, or results from the use of the Platform.

FanCake does not guarantee that creators will earn income and is not responsible for disputes between creators and fans.

 

 

 

 

9. Limitation of Liability

 

 

To the fullest extent permitted by law, Roberto Calvo Productions LTD shall not be liable for:

 

  • Lost profits or revenue;

  • Data loss or corruption;

  • Payment processing issues caused by Stripe, PayPal, or other third parties;

  • Damages arising from user content or platform misuse.

 

 

 

 

 

10. Governing Law and Jurisdiction

 

 

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom.

However, for any dispute arising out of or relating to the use of the Platform, the competent court shall be the Court of Foggia (Italy).

 

 

 

 

11. Updates to the Terms

 

 

We may update these Terms from time to time. The updated version will be posted on the Platform with a new “Last Updated” date. Continued use of FanCake after such updates constitutes acceptance of the revised Terms.
